Commercial License Terms

1. COMMERCIAL LICENSE GRANT

An active Authorized Merchant Club membership grants you a non-exclusive, non-transferable, revocable license to manufacture and sell physical products made using eligible 3DLUNCHBOX designs.

This license allows you to:

• Manufacture physical 3D-printed products based on eligible 3DLUNCHBOX designs.
• Sell those physical products directly to customers.
• Sell physical products through your own website, online store, marketplace, social media, craft fairs, conventions, and other retail channels.
• Use photographs and videos of your finished physical products for marketing and advertising.
• Produce multiple physical copies of the licensed designs for commercial sale, subject to the limitations of this license.

This license does not transfer ownership of the underlying designs or digital files to you.

2. AUTHORIZED COMMERCIAL USE

The Commercial License is intended for individual sellers, creators, makers, and small-scale businesses producing and selling physical products. You may sell finished physical products made from 3DLUNCHBOX designs under your own business or brand.

You may:

• Set your own retail prices.
• Create your own product listings.
• Package and brand the finished physical products.
• Photograph, film, advertise, and promote your finished products.
• Combine the printed design with other materials or components to create a finished physical product.

Your business remains responsible for complying with all applicable laws, marketplace policies, product safety requirements, labeling requirements, and other regulations relating to the products you sell.

3. DIGITAL FILE RESTRICTIONS

The digital files provided by 3DLUNCHBOX are licensed, not sold, to you. You may not:

• Resell STL, 3MF, OBJ, STEP, or other digital files.
• Share the digital files publicly or privately.
• Upload the files to file-sharing websites, cloud storage accessible by others, Discord servers, Facebook groups, Telegram groups, or similar platforms.
• Give the files to customers.
• Give the files to friends, family members, other creators, or other businesses.
• Include the digital files with physical product purchases.
• Sublicense the digital files.
• Claim ownership of the original digital files.
• Use the files to create or operate a digital download service.

The digital files must remain under your control and may only be used for the purposes permitted by this license.

4. THIRD-PARTY PRINTING SERVICES

You may use a third-party 3D printing service or manufacturer to produce physical products on your behalf, provided that the files are used solely for fulfilling your authorized production requirements.

The third party must not:

• Resell the files.
• Redistribute the files.
• Use the files for their own commercial products.
• Upload the files to public or shared libraries.
• Manufacture products independently from your business relationship.

You are responsible for ensuring that any third-party manufacturer you use respects these restrictions. Once production is complete, you should take reasonable steps to ensure that the digital files are no longer accessible to the third party.

5. WHOLESALE & B2B SALES

The Authorized Merchant Club is intended primarily for retail and direct-to-customer commercial sales. Occasional or limited wholesale transactions may be permitted, such as selling a small quantity of finished physical products to a local store or business.

However, the Merchant License does not cover businesses whose primary activity is regular wholesale or B2B distribution.

Businesses that:

• Regularly supply 3DLUNCHBOX products to stores or other businesses,
• Operate primarily as a wholesaler or distributor,
• Maintain ongoing B2B supply relationships, or
• Generate more than $25,000 USD in annual gross revenue from physical products made using 3DLUNCHBOX designs

are required to use the Authorized Wholesale & B2B License. The Wholesale / B2B License is available as a separate Patreon membership tier.

6. REVENUE THRESHOLD

The $25,000 USD annual revenue threshold applies specifically to gross revenue generated from physical products made using 3DLUNCHBOX designs. It does not refer to your total business revenue, revenue from unrelated products, revenue from unrelated businesses, or your personal income.

For example: If your business generates $100,000 in total annual revenue, but only $10,000 comes from products made using 3DLUNCHBOX designs, the $25,000 threshold has not been reached. If your business generates $30,000 in annual revenue from products made using 3DLUNCHBOX designs, the Wholesale / B2B License is required.

7. WHOLESALE CUSTOMER RESTRICTIONS

When selling physical products to another business under the Merchant License, the transaction must remain a sale of finished physical products. You may not:

• Transfer the original digital files to the buyer.
• Give the buyer permission to manufacture the design.
• Sublicense the design to the buyer.
• Allow the buyer to reproduce the design from your digital files.
• Represent the buyer as an authorized licensee of 3DLUNCHBOX.

A business that purchases your finished physical products may resell those physical products as permitted by its own business arrangements, but this does not give that business any rights to the original 3DLUNCHBOX digital designs.

8. MANUFACTURING & MASS PRODUCTION

The Merchant License does not automatically grant permission for industrial-scale manufacturing or mass production. Examples of uses that require separate written permission may include:

• Injection molding.
• Large-scale factory production.
• Industrial manufacturing.
• Licensing a design to a manufacturer.
• Producing products through a manufacturer for independent distribution.
• Manufacturing thousands of units as part of a large commercial contract.
• Transferring production rights to another company.

These arrangements may be considered for a separate Wholesale, Enterprise, or Custom Licensing Agreement.

9. MODIFICATIONS

You may make reasonable modifications to a 3DLUNCHBOX design for the purpose of manufacturing your own physical products. However, modifications do not transfer ownership of the original design to you.

You may not:

• Claim the original 3DLUNCHBOX design as your own.
• Sell or distribute modified digital files based substantially on 3DLUNCHBOX designs.
• Upload modified versions to digital marketplaces.
• Use modifications as a way to redistribute the original digital design.

Physical products incorporating reasonable modifications may be sold under this Commercial License, provided that the underlying product remains within the permitted scope of this license.

10. COMBINING DESIGNS WITH YOUR OWN PRODUCTS

You may combine 3DLUNCHBOX physical prints with your own materials, components, accessories, packaging, or other products to create a finished physical product (e.g., adding accessories to a printed figure, creating a display product around a design, painting/finishing a printed model).

Your own original elements remain your property. However, this does not grant you ownership of the underlying 3DLUNCHBOX design.

11. MARKETING & ATTRIBUTION

When showcasing, advertising, or posting physical products made using 3DLUNCHBOX designs, you are requested to credit: 3DLUNCHBOX. Where practical, please include @3dlunchbox_ or another appropriate reference to the brand.

Attribution helps customers discover the original designer and allows 3DLUNCHBOX to potentially reshare your work. Attribution does not grant you permission to represent yourself as the owner, creator, or official representative of 3DLUNCHBOX.

12. BRAND & INTELLECTUAL PROPERTY

The 3DLUNCHBOX name, logos, branding, artwork, digital designs, characters, and related intellectual property remain the property of 3DLUNCHBOX and/or their respective rights holders. Your Commercial License does not grant you ownership of any intellectual property, permission to register designs as your own, or permission to use the brand as your own brand.

13. ACTIVE MEMBERSHIP REQUIREMENT

Your Commercial License is valid only while your Authorized Merchant Club membership remains active and paid. If you cancel your membership or fail to maintain your subscription:

• Your Commercial License immediately ends.
• You may not manufacture new products using the licensed designs.
• You may not continue producing new inventory using the licensed designs.
• You may not begin new commercial production using previously downloaded files.

Physical products that were lawfully manufactured while your license was active may remain in your existing inventory and may be sold after cancellation, unless otherwise required by applicable law.

14. PREVIOUSLY DOWNLOADED FILES

Downloading a file while subscribed does not create a perpetual commercial license. Your right to use the design commercially is tied to your active membership. If your membership ends, you must stop creating new physical products using the licensed designs. You may retain downloaded files for personal archival purposes, but they may not be used for new commercial production after the license ends.

15. LICENSE HOLDER

The license is granted to the Patreon member or business associated with the subscription. You may not transfer your license to another person or business. A separate business, partner, client, manufacturer, or customer does not automatically receive a Commercial License through your membership.

16. PROHIBITED USES

The following uses are strictly not permitted under this Commercial License:

• Reselling, sharing, or distributing digital files.
• Uploading files to public repositories.
• Creating digital download products from 3DLUNCHBOX designs.
• Sublicensing or transferring design rights to another person or company.
• Claiming ownership of 3DLUNCHBOX designs.
• Using the designs to create competing digital STL memberships or libraries.
• Giving customers access to the original files.
• Allowing another business to independently manufacture products using the licensed files.
• Industrial or mass production without separate authorization.
• Using 3DLUNCHBOX branding in a way that falsely suggests ownership or official representation.

17. LICENSE VIOLATIONS

If 3DLUNCHBOX determines that a member has violated these terms, the license may be terminated immediately. Remedies include revoking the Commercial License, removing the member from Patreon, restricting access to digital files, refusing future commercial licensing, and pursuing legal remedies.

18. NO OWNERSHIP TRANSFER

Purchasing a Patreon membership or downloading a 3DLUNCHBOX design does not mean that you have purchased the design itself. You are purchasing access to the designs and receiving a limited license to use them according to these terms.

19. LICENSE CHANGES

3DLUNCHBOX reserves the right to update these Commercial License Terms when necessary. Any updated terms will apply to future uses of the designs after the updated terms become effective.

If you are unsure whether a specific use is permitted, please contact 3DLUNCHBOX before proceeding. For larger commercial projects, wholesale distribution, factory manufacturing, or custom licensing, please contact 3DLUNCHBOX directly.
